DSA REGULATIONS - Digital Services Act
This is a legal act of the European Union that imposes responsibility on companies for the content posted on their websites in order to improve online security for the proper functioning of the digital environment, support the fight against illegal content, and also specifies issues related to content moderation, removing illegal content from the Internet (spreading hatred, violence or child pornography). The regulation came into force on February 17, 2024.
1. LabaTime ensures that the content posted on the website in connection with the apartment rental business by itself and also by Users (comments, opinions and ratings) is legal and safe for the digital environment.
2. As part of the website, we allow Users to leave content and information (comments, ratings and opinions) regarding the services provided.
3. Illegal content is content that contains references to legally prohibited situations or is contrary to good customs. This may be offensive content, or content that violates religious feelings, personal rights or shows a lack of respect in accordance with generally understood social norms and principles of social coexistence; racist, vulgar content, content that promotes violence, contains pornographic content, fascist, discriminatory, sexually suggestive content, inappropriate for minor users, etc., but also content that contains hate, vulgarisms or is commonly considered spam. There is no consent to post illegal content, if it appears, actions will be taken to remove it, and the noticed fact will be reported to the Authorities dealing with illegal content on the Internet.
4. A contact point (DSA contact) is established, available in the "Contact" tab on the website, the e-mail address is kontakt@labatime.pl. This is a communication channel through which the Authorities or Users of the service will be able to report any suspected illegal content that has been found on the website. It will also serve to provide the appropriate Authorities with information about Users posting the aforementioned content. Through the aforementioned contact point, Authorities and Users can communicate with the service.
5. Any person or entity may report to the service the appearance of specific content deemed illegal on the service through complaints or appeals for non-compliance with the provisions resulting from the DSA, the communication channel. These will be considered immediately, no later than 14 business days, also in the same way. The complaint mechanism is free of charge and allows electronic filing of complaints about the presented content.
6. The owner of LabaTime is responsible for moderating the content, monitoring the materials shared on the site also by different Users and responding if necessary. Personal control of the content at least once a day, and immediate response in the event of a decision on the existence of prohibited content; notifying the author of the content, requesting its removal or restriction, blocking the content and removing it from the site, notifying the Authority about illegal content. Users whose entries are deleted or accounts blocked receive an explanation of the reasons for these restrictions with information about which provision they have violated. They can appeal the decision to remove the content or block the account. The bodies for resolving disputes over the admissibility of content on the network and the courts will supervise decisions regarding the removal of content and the blocking of accounts.
7. Information about any changes in the scope of contact points or the terms of use of services, as well as the provision of an internal system for handling complaints regarding content moderation, will be updated on an ongoing basis in the "Contact" tab on the website and in the DSA Regulations.
